GENERAL ADA RENTAL CONDITIONS

-to have had your driver’s license for more than two years

1. Which documents must I provide ?

If you wish to rent as a private individual, you must justify:
-Your last name, first name, address by means of your driver’s license.

If you are going to use your bank card, this procedure is lightened.
*For companies, your registration in the Trade Register or in the Occupation Register by means of a Kbis extract.
*An authorization to rent the vehicle in the company’s name if you are not the legal representative of the company.
*A bank account identification slip of the company
*An order slip signed by the legal representative of the Hirer and mentioning the RCS number.

2. What am I renting ?

The vehicle that will be handed over to you is in accordance with the Rental Contract and is the one represented in the vehicle description sheet. Before taking charge of the vehicle, you must fill out with the owner the description sheet and thus recognize the contradiction of the said description. The renter offers only vehicles in good working condition. However, you can verify the vehicle for a distance of 3 kilometres, past which the vehicle will be considered to be in accordance with its destination and exempt from mechanical defects.

Warning : The Hirer accepts, in the case where he/she would refuse to sign the description sheet of the car, that the Renter would turn to an independent automobile expert in order to establish a descriptive state, and that the cost of this intervening party will be invoiced to the client. If the Hirer does not take possession of the vehicle, the Renter will keep a fraction of the price of the rental and the vehicle will be considered available for rental.

3. What can the vehicle be used for ?
The rental is personal and non-transferable, but you can designate one or more drivers who must be authorized by the Renter and designated on the contract.
You commit to carefully driving the car and respecting the Highway Code.
You commit to making sure that the vehicle is not used:
-For the paid transport of passengers no matter what the form of payment and no matter what written or verbal agreements have taken place.
-For propelling or pulling the vehicle or using a trailer or any other rolling object.
-For competitions.
-For illicit purposes.
-For teaching somebody to drive.

You commit to keeping the said vehicle closed and locked when you are not using it and keeping the keys with you, which should never be left inside the car.
You should under no circumstances give away, sell, mortgage, or pawn the contract, the vehicle, the equipment, or the tools, or use them in a way which would harm them.
You commit to neither modifying nor adding equipment to the rented vehicle.

The end of the contract is realized with the return of the vehicle with its original keys to one of the Renter’s employees, in the station, at the date and time agreed upon in the rental contract. If you don’t hand over these things to the person in charge, the end of the contract will take place at the time at which the agency opens on the first work day following the return of the keys.

4. Who is authorized to drive ?

Drivers between the ages of 21 and 25 for vehicles in category E, 5 and 6, who have had their driver’s license B for at least one year and five years for categories E, 5 and 6.
The drivers designated by you and approved by the Renter:

Warning : Only the drivers designated on the rental contract have at their disposal insurance benefits. As a result, when the vehicle is driven by a driver who is not designated on the contract, the Hirer alone is responsible for the totality of the costs resulting from any possible damages (in accordance with the provisions in article L-211.1 from the Insurance Code concerning the driving of vehicles against the will of the Renter). Finally, we remind you that the Hirer is financially responsible for the use of the vehicle by all approved drivers.

5. How am I insured ?

Who is insured?
Only the drivers designated on the rental contract and for the duration agreed upon (until the return of the keys and papers to the Renter during the agency’s hours of operation) have at their disposal and insurance benefits under the contract made with the Renter.

What insurance is acquired by the signing of the contract?

The drivers designated on the contract benefit from automobile insurance signed by the Renter covering the Civil Responsibility for the damages caused by a third party, for theft or attempted theft, fire and all other damages to the rented car (with a deductible of 100,000 to 200,000 CFP (between 839 to 1676 euros)(for tourism vehicles)(between 200,000 CFP/1676 euros) (for commercial vehicles), which is doubled in case of theft or when the drivers is less than 23 years old, according to the category of the vehicles and the particular provisions made in paragraph 6).
 
Warning: The insurance policy is available only in New Caledonia, being understood that the use of this vehicle outside of the country’s limits is likened to the theft of the vehicle by the Hirer, who will be exposed to the civil and penal consequences resulting from this crime.

What will I have to pay for in case of damage?
There are two possible cases:

  1. If you are not responsible for the damage, and the insurers were able to attribute the totality of the responsibility of the damage to a third party, you won’t owe anything and this deductible is not applied.
  2. Or you are responsible for the damage, and you are covered by the insurance, you only owe the deductible (compensation corresponding to your contribution to the insurance through a loss of no-claims bonuses), and this, according to the amounts specified in the conditions of the rental contract, subject to particular provisions from paragraph 6.

Warning: We remind you that, in the case where the Hirer is implicated in several accidents during the duration of the rental, each accident will individually go through the described steps above.

What are the amounts of the deductibles?
The insurance for the Deductible Reduction allows the insured person to pay only a reduced deductible in case of an accident (if he/she is responsible or not). All of our fix prices include this Deductible Reduction.
You therefore do not have to pay an extra cost to benefit from this. (deductible of 100,000 to 200,000 CFP (equivalent to 839 to 1676 Euros) (for tourism vehicles) (deductible of 150,000 to 200,000 CFP/equivalent to 1257 to 1676 Euros) (for commercial vehicles), doubled in case of theft, or when the driver is under 23 years of age, according to the category of the vehicle and the particular provisions made in paragraph 6).
The amount of the deductible for broken windows is pointed out on the validated rental contract by the client (the amount may vary according to the type of vehicle).

6. When am I not insured ?

You are not insured in the following ten cases:

  1. If you are unable to return to the Renter the vehicle’s original keys after having certified that is has been stolen. In this case, you will be required to pay for the entire value of the car as estimated by an expert.
  2. When the damages on the vehicle are the result of burns, interior deteriorations, excess weight, a lack of respect concerning the size of the car in particular on the high parts, damages caused underneath the vehicles and their mechanical consequences, as well as tire, hubcap, and rim damage.
  3. When the driver is in a drunken state as defined by the Highway Code, or when the driver has used dugs or other legally forbidden narcotics, or when the driver has taken medicine, medically prescribed or not, whose notice clearly warns against not driving because of the sleepiness it causes.
  4. When the vehicle’s damages occur subsequently to the return date agreed upon in the present contract, this case will be likened to driving against the will of the Renter and the theft of the car. This measure does not apply if you have received the Renter’s permission to have an extended rental period.
  5. If you or the driver have provided the Renter will false information concerning your identity or the validity of your driver’s license. The same will apply for the accident report, the damage report, or the vehicle’s description at the time of returning the car.
  6.  For the damages or loss of personal items, objects, of animals inside the car.
  7. When the damages result from a voluntary action by you or the driver.
  8. When the vehicle is used for paid transport of passengers or for teaching somebody to drive.
  9. When the vehicle is rented or filled with too many passengers or heavy objects as authorized on the car registration papers.
  10. For broken windows.

 

7. What must I do in the case of a breakdown, an accident, theft, or destruction of the vehicle ?

In the case of a breakdown, an accident, theft, or destruction of the vehicle, call 24 hours a day, 7 days a week, the TELEPHONE NUMBER PRINTED ON THE FOLDER: “IMPORTANT VEHICLE PAPERS”.

For all other information, directly contact your rental agency.

Attention: As for what concerns assistance with the vehicle, the Hirer agrees to comply with the instructions that will be given to him/her by the correspondent. If he/she does not comply, the Hirer is financially responsible for the allowances that he/she spent without the prior permission of the correspondent.

8. What are my obligations in the case of a theft or an accident ?
You, or the designated driver, or any other designated drivers on the contract, commit to respecting the three following obligations:
-To report the theft, or the attempted theft of the vehicle to the police authorities and to the Renter as soon as you find out about it, and to provide the Renter within 24 hours the vehicle’s original keys.
-To immediately declare to the Renter any traffic accident involving the rented vehicle and to give the Renter a legible copy of the joint insurance statement made by the two drivers after the accident, filled out and signed by both parties as well as by the witnesses, if there were any. In the case of an accident without a third party, you will have to fill out this insurance statement alone writing down the exact causes and nature of the damages.
-To contact the “helper” mentioned in paragraph 7.

9. What do I have to pay to the Renter ?

You will have two types of costs:

  1. the sure costs, which means:

-the price as be will determined by the particular conditions and which depends on the duration of the rental and the number of kilometres covered as well as all other extra charges.
-the cost of missing fuel
-the service allowances that you requested from the Renter

  1. Supplementary costs, notably:

-the insurance deductible or the repair costs due to an accident (the cost of the deductible represents your contribution to the insurance, in particular the increase in charges due to a loss of no-claims bonuses), and the damages to the vehicle that are not covered by the insurance contract.
-for damages which cost less than the deductible, the rate will correspond to the estimate (made by an approved vehicle manufacturer) that will be applied to the extra charges for the days where the vehicle was not available, before and after the repair.
- the tickets or fines against you relating to your use of the vehicle.
-parking costs
-the costs of an expert’s advice concerning the vehicle
-the immobilization costs not exceeding a half day’s rental based on the general rate of 150 kilometres.
-the damage management costs, which have an inclusive price of 10,000 CFP (before taxes) per accident (equivalent to 84 euros).
-cancellation costs (according to the general rate conditions) 30% of the rental
-an extra day’s rental will be charged to the Hirer if he/she does not bring back the vehicle at the agreed date and time, with a grace period of sixty minutes.

Warning: the Hirer will be financially responsible for any fuel errors (for example, diesel instead of super). The Hirer accepts from now on that the Renter can deduct the owed money from his/her bank account by VAD or by cashing a check, agreed upon by both parties at the time of the signing of the contract, and the paying of the deposit. It is specified that in the case of a rental which is longer than 7 days, the deposit, according to the amount indicated by the general rate, will be deducted at the time of rental, and given back, without interests, at the end, on the condition that all of the above conditions were respected.

10. The Computer and Freedom Law

In accordance with the Law n° 78-17, the Hirer has the right to access, modify, rectify, and cancel the data concerning him/herself.

11. Draw up a description of the vehicle with the Renter.
