The present conditions depart from the general conditions and prevail over all other stipulations contrary to the general conditions.

3) Use of the vehicle
The Hirer is authorized to use the vehicle only on asphalted roads, such as the RT1 (the road leading to Yaté and the waterfall of Goro), with the exception of all trails, except if the vehicle is a 4x4.
Small concrete/asphalted passages should be driven over at a speed inferior to 10km/h with a water level of less than 20cm.

5) How am I insured?
Article 5 is replaced with what follows:

Who is insured ?
Only the drivers named on the rental contract and for the whole duration of the rental (until the return of the keys and papers to the Renter during the Agency’s working hours) has at his/her disposal the right to be insured according to the insurance contract with the Renter.

What kinds of insurance benefits do I get from the contract ?
The driver named on the contract benefits from an automobile insurance signed by the Renter covering the Civil Responsibility for the damages caused by a third party, for theft, attempted theft, fire and damages to the rented vehicle (with a deductible of 100,000 to 200,000 Pacific Francs through a claim process, according to the category of the vehicle and the particular provisions from paragraph 6).

What insurance options do I have ?
If the client wishes his/her insurance application to be expedited, the deductible can be reduced to a daily rate.

What will I have to pay for in case of damage ?
There are two possible cases:

If you are not responsible for the damage, and once the insurers are able to attribute the totality of the responsibility of the damage to a third party, you won’t owe anything and this deductible is not applied.

If you are responsible for the damage, and once this is covered by insurance, you will only owe the deductible or a fraction of the deductible which is not covered (a compensation corresponding to your contribution to the insurance) and this, not exceeding the amounts specified in the conditions of the present rental contract, with particular provisions from paragraph 6).

6) When am I not insured ?
The cases of non-coverage concerning the general conditions in Article 6 remain the same, with the exception of the case concerning point 3, for which the state of drunkenness extends from the definition of this state by the rules and regulations in New Caledonia.

7) What should I do in case of a problem ?
You should call the Renter at 28.85.02 or 78.35.50.
The other stipulations from Article 7 of the general conditions remain unchanged.

8) What are my obligations in case of a theft or an accident ?
You should call the Renter at 28.85.02 or 78.35.50.
The other stipulations from Article 8 of the general conditions remain unchanged.

9) What do I have to pay to the Renter ?
There has been no change to this article except for the first sentence of the paragraph “Attention” where it is agreed that the Hirer will be indebted for repairs resulting from any fuel or liquid errors.

9 bis) Jurisdiction
“In the case of a dispute, only the Courts of Nouméa are capable of handling the situation.”
